Terms and Conditions

Definitions

In these terms and conditions, the following definitions apply

Tutor: Simon Horsnall

Client: The person paying for the tutoring services

Student: The person to whom tutoring services are being delivered

Session: 60 minutes face to face tutoring time unless otherwise agreed in writing

Recurring booking: a regular time slot booked by a particular Student which continues without breaks until terminated, unless agreed otherwise

Payment terms

The Client agrees to pay the Tutor at the rate specified in the payment schedule when booking. Any planning is included in the cost of the Session. The Tutor will provide informal verbal feedback to the Client as a routine measure. Should the Client or Student require marking of past papers, written feedback and assessment or similar administrative tasks to be carried out, these will be charged at a rate of £25/hour or part thereof. Where payment is not made at time of booking, an invoice will be issued on the last working day of each month and payment becomes due 10 working days thereafter.

Late payment

A £10 late fee will be applied to invoices not paid within 10 working days. No further Sessions will be scheduled until payment of the outstanding balance in full.

Cancellations and rescheduling

If the Client or Student needs to cancel or reschedule a Session, at least 24 hours’ notice must be provided. In the event of the Client cancelling at less than 24 hours notice, the full cost of the Session may be charged at the Tutor's discretion.

 

If the Student is not present within 15 minutes of the start of a scheduled Session without prior notification, the Student will be considered a no-show and the Session cancelled. Where the Tutor cancels a Session, that Session will be rescheduled at no further cost to the Client. Notice of cancellation must be delivered by text message or email.

Neither party shall be considered in breach of this agreement where circumstances beyond reasonable control prevent a Session from taking place.

Tutor responsibilities
  • The Tutor agrees to:

    • Provide Sessions tailored to the needs and abilities of the Student

    • Arrive on time

    • Maintain reasonable confidentiality regarding the Student’s personal and academic performance

 
Student responsibilities
  • The Student agrees to:

    • Be on time and prepared for each Session

    • Complete any assignments set by the Tutor

    • Notify the Tutor with any scheduling issues

    • Not copy, distribute or exploit any materials provided by the Tutor which remain the intellectual property of the Tutor

 

Liability

The Tutor will take reasonable care to provide tutoring services appropriate to the level and ability of the Student. The Tutor cannot guarantee any academic performance, examination result or grade as a result of the tutoring offered.

To the fullest extent permitted by law, the Tutor’s liability arising out of or in connection with the tutoring services shall be limited to the fees paid by the Client in the three months preceding the event giving rise to the claim.

Safeguarding

During all Sessions, a responsible adult must remain contactable. In most cases this will mean being in the same building as the tutoring Session. Under no circumstances will the Tutor agree to begin or continue a Session whilst there is no adult in the same building as that in which tutoring is being delivered.

Confidentiality

Both parties agree to keep the details of this agreement and the Student's personal and academic information confidential, unless written consent is given for disclosure.

Personal data will be stored only where reasonably necessary for the administration of tutoring services and will be handled confidentially and in accordance with applicable data protection law. Data will not be shared with third parties except where legally required.

Personal data no longer required for the provision of tutoring services will be securely deleted within a reasonable period.

Termination

Where this agreement relates to a recurring booking, either party may terminate this agreement by providing one week's written notice. The Client will be responsible for any outstanding fees up to the termination date.

General provisions

This agreement shall be governed by the laws of England and Wales.

These terms constitute the entire agreement between the parties unless otherwise agreed in writing.
